This document (including any other documents referred to within it) provides details of the terms and conditions on which we will supply our tours and activities.  

Information of tours and activities are detailed on our website, budgettravelmorocco.com

It is important that you read these Booking Terms & Conditions carefully before booking any of our services.  You should understand that by making a booking with us you agree to be bound by both these terms and conditions quoted here in this document including the Website Terms & Conditions below.

We would suggest that you print a copy of these terms and conditions for your future reference. 

budgettravelmorocco.com is part of a travel company based in the UK. 

A. Your contract

Your contract is with budgettravelmorocco.com (on behalf of Morocco Memories Ltd), and is herein after referred to as “the Company,” “We” or “Us.”   “You,” the client, are subject to the Terms and Conditions herein. 

B. Acceptance by budgettravelmorocco.com

We reserve the right to refuse any bookings from any prospective clients that in the company’s opinion they may consider to be unsuitable.  The company does not need to provide any prospective clients the reason for its refusal. 

C. Booking procedure and payment

To enable a booking to be secured, you are required to complete the online booking along with the appropriate payment for the tour and/or activity to be provided. 

If you have a group that requires a group booking you can contact us by email to make a group booking for the services to be provided.  Otherwise you should use this website online booking system.

The total cost of any tour or activity should be paid at the time of booking online. By making the booking online you confirm that you have read, understood and agreed to both these Terms & Conditions e.g. Booking Terms & Conditions as well as Website Terms & Conditions detailed below.

We have set up accounts with PayPal and Stripe to protect your transactions with us. On receipt of your payment by PayPal or Stripe you will normally receive confirmation of your booking within 72 hours. From this point, you should note that a Contract exists between you and us. 

If you wish make a booking whereby you pay in another currency e.g. Euros or Dollars via Stripe or Paypal you will be responsible for any ancillary costs for this transaction e.g. exchange rates or exchange admin fees. If you wish to make a booking directly to us in another currency you should should contact us before making any booking.

When you are in Morocco, you will also be able to book or tours or activities using our website. 

If payment is not made according to these aforementioned conditions, then the tours or activities will be treated as uncompleted and therefore cancelled.  

Please note that your booking will not be confirmed until payment is received via PayPal or Stripe.  You will also have to provide relevant personal details to us to confirm the booking e.g. email address, date of booking, type of booking etc. If you do not supply the correct information, your booking may be delayed.

It should also be noted that we also reserve the right to cancel your booking if payment is declined.

D. Flight arrangements to be made by you

Currently, we do not arrange flights to Morocco.  Therefore, your flight arrangements will be made independently by you.  If your flight is cancelled or delayed, we cannot accept any liability for any delays if as a result of this flight cancellation or delay that means you are unable to take part on date/time in respect of the tour or activity booked by you. If you are unable to attend your chosen tour or activity this will be deemed to have been cancelled by you. Please refer to section G in respect of cancellations etc. 

E. Passport, documentation and personal property

It is your responsibility to check that your passport is up to date and to ensure that you always carry the correct documentation (passport, visa etc.).  

It is also your sole responsibility to look after your personal property during the tours and activities arranged by us. We accept no responsibility or any contingent liability for them from theft or loss from any accommodation arranged by either you or us or from theft from transport provided as part of your tour or activity.

F. Our tours and activities

Tours and activities are as listed in our website and booked and paid on our website.  If you deal with other local organisers or guides for any tours/excursions or activities not included in your booking with us, please note that we will have no liability for these tours/excursions or activities. Your contract for these tours/excursions or activities will be with the persons or company you have contracted to provide these services and not with us.

G. Cancellations, amendments made by you

You should contact us to advise of any cancellation. 

For cancellations more than 48 hours before the start of the tour or activity a full refund of the Booking Price will be made. 

For cancellations 48 hours or less before the start of the tour or activity or in case of a no show no refund will be payable. 

For the avoidance of doubt, for example, if you book for Thursday, you can cancel any time BEFORE 8:00 a.m. on Tuesday. 

We should receive written confirmation from you to cancel the booking. This should be done by email. As confirmation and proof of the cancellation, we will acknowledge receipt of your email. Our confirmation emails should be retained by you as proof of cancellation. 

Any refund due after a cancellation more than 48 hours before the start of the tour or activity will be issued using the original payment method used for the purchase of the tour or activityand will be refunded as soon as praticable.

H. Cancellations, amendments or alterations made by the Company

We reserve the right to cancel any of the tours or activities in the unlikely event that the service provider is unable to provide the stipulated services. In this event, we will try to arrange to put you on another group tour or activity.

We reserve the right to make any changes to the published tour itinerary or activities either prior to your departure or during your trip (for example due to technical or maintenance problems).  It is important to note that travelling in either a group tour or activity can mean that occasional changes (for example due to the result of adverse weather conditions) may be necessary.  A priority for us is you and your safety.

I. Force majeure

It may be necessary for us to be forced to cancel your services or tours for reason(s) beyond our control because of “force majeure.”  We cannot accept any liability or pay any compensation where it is not possible to meet our agreed contractual obligations or you suffer any loss or damage as a result.   As per these terms and conditions force majeure means circumstances or events that we or our providers could not anticipate or potentially avoid, such as:

Threat of war, actual war, insurrection, civil action, terrorist actions, decisions by governments or governing authority, riots, strikes, bad weather, natural disaster, natural or nuclear activity, technical or maintenance problems with transport contracted, changes to schedules or operation decisions of air carriers selected by you, industrial action, epidemics or pandemics, adverse weather conditions, fire or any similar circumstances that are beyond our control. 

J. Prices

The information and prices shown on our website will be confirmed when you have booked and paid for your selected tour or activity.  If we have provided a quotation for a group, we will inform you of any changes prior to booking your tour or activity.  We make every effort to ensure the accuracy of the website and/or any quotations issued directly to you rather than on our website. Unfortunately, errors sometimes occur.  Therefore, please ensure that you check all the details including the price provided of your tour or activity if booked with us directly rather than on the website.  

K. Insurance cover

It is a condition of the booking that you are adequately insured against personal accident, injury and any medical expenses incurred.  It is your sole responsibility to ensure that you are adequately covered for any tours or activities you have arranged with us (e.g. hiring of quad bikes).  We do not offer to arrange any insurance cover as part of our services or tours.  We do not require a copy of your insurance policy and do make not any judgement or comments as to the suitability of any insurance cover selected by you (and, if applicable, your group).  We will assume that at the time of booking you have arranged adequate insurance cover for your trip.

L. Your responsibilities

Once your booking has been made and accepted by us, you understand and accept the following: -

• The risks and hazards of tours or activities that you have arranged. Particularly, the risks and hazards associated with quad bikes, paragliding or any other types of activities etc. arranged with us
• The possibility of delays and/or amendments that need to be made due to factors beyond our control and even if this may cause you inconvenience, discomfort or concern. 
• Whilst on any tour or activities, you accept the instructions and authority of the guide/leader of the tour or activity. If your behaviour is detrimental to the safety or welfare of the group, it may be necessary to asks you to leave the group tour or activity.  It is important for all the tours and activities that that you endeavour to be flexible. 
• The daily agenda or objective of the tour or activity, as published on the website, or as agreed with you, is taken as an aim and is not a contractual obligation. 
• Our agreed supplier may make immaterial changes to the details of the tour or activity at any time due to circumstances arising at short notice. We regard immaterial changes to the details of the tour or activity such as a change of the starting/meeting point for the tour or activity, we will provide you with details of the new meeting point.  A change of the start/meeting point is possible up to 48 hours before the start of your booked tour or activity and will be advised to you by email, WhatsApp or text. 
• You agree that it is a fundamental condition of the group tour or activity that you accept the need to be reasonably flexible, and you acknowledge that delays, alterations or cancellation may be required and understand that their subsequent effects may possibly lead to your inconvenience, discomfort or disappointment.
• Your tour or activity does not commence until the appointed time and designated meeting point as agreed with you.  If you fail to arrive at the appointed time and designated meeting point for whatever reason, we will not be responsible you thereafter. 

M. Complaints

If you have any complaints about any aspect of your tour or activity, please inform us immediately. 

You will be able to contact us using the with telephone number shown on our Website. This number is available in Morocco on WhatsApp as well as in the UK.  

Most problems can usually be dealt with on the spot.  It is important to note that if you failed to report a problem or issue that could have been resolved at the time, we cannot accept any liability in respect of that complaint or issue. 

If, however, an acceptable solution cannot be found, then you will have the opportunity to write to us within 30 days of your return.  You must provide us with full details of your complaint or issue. Please note that if you do not follow the above complaints procedure then your right to claim possible compensation may be affected or potentially lost as a result.
